SmartSleep Terms of Use (EULA)

These Terms of Use ("Terms") govern your use of SmartSleep ("the App") provided by R122104 ("the Developer"). By using the App you agree to these Terms.

1. License

The App is licensed under Apple's standard Licensed Application End User License Agreement:

2. The Service

The App tracks your sleep on Apple Watch and wakes you with a gentle vibration during light sleep.

3. In-App Purchases

Some features are unlocked by a one-time in-app purchase.
Purchases are processed by the Apple App Store and are subject to Apple's terms of sale.
Use "Restore Purchases" in the App to restore a purchase on a new device.
Refunds are handled by Apple in accordance with Apple's policies. The Developer cannot issue refunds directly.

4. Prohibited Conduct

You must not:

use the App in violation of any law or public order;
interfere with the operation of the App;
reverse engineer, decompile, or disassemble the App;
redistribute or resell the App;
engage in any other conduct the Developer deems inappropriate.

5. Disclaimer

The App is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or availability.
Sleep, heart-rate, and similar figures shown in the App are for reference only. The App is not a medical device and must not be used for diagnosis or treatment. Consult a medical professional for health concerns.
To the extent permitted by law, the Developer is not liable for damages arising from use of the App.

6. Changes and Termination

The Developer may change or discontinue the App without prior notice.

7. Changes to These Terms

The Developer may revise these Terms. Revised Terms take effect when posted on this page.

8. Governing Law and Venue

These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
